
Q) If an employee wants to take a break, what is the minimum period they are entitled to?
A) If they are under the age of 18 then they are entitled to 30 minutes every 4.5 hours. However, if they are aged 18 or over, then they are entitled to 20 minutes every 6 hours.
Q) How old must a person be before a company can employ them?
A) The youngest age of employment starts at 14 years of age. However in some high risk employment jobs this is raised to age 18 or over.
Q) I have been employed for over 2 years, when will I be entitled to claim unfair dismissal?
A) If you have been continuously employed for a year then you can claim for unfair dismissal.
Q) How long am I entitled to maternity leave?
A) If you are an employee you have the right to 26 weeks of ordinary maternity leave and 26 weeks of additional maternity leave, this in total allows 52 weeks (one year) known as statutory maternity leave.
Q) What are my employees entitled to in respect of minimum holiday leave?
A) An employee is entitled to 5.6 weeks minimum paid holiday leave. This is 28 days for someone who works five days a week. However an employer could offer more than this if they want to. Part time workers are also entitled to the same amount of holiday leave as full time workers are on a pro rata basis.
Q) How much will I get paid for holiday leave?
A) You will get paid the same amount of money as you do when you are working so it will be your normal salary.
Q) I am being discriminated against at work, is there a specific amount service requirement I have to have worked before I can claim for discrimination?
A) No. Unlike unfair dismissal there is no service requirement for discrimination. You can claim discrimination regardless of how long you have worked there.
Q) If I witness an employee stealing from the company how long is it before I can terminate their employment with the company?
A) As an employer you are entitled to dismiss an employee as soon as you catch them stealing from the company. However you must follow this dismissal up by writing to the employee in question about why you are ending his employment with the company. You must also allow the employee to appeal against this judgment.
Q) Are there any other ways I can settle a dismissal without going to court?
A) Yes, a compromise agreement can be agreed between yourself and your employer which is an effective way of being compensated for your dismissal without going to court.
