Speeding

Official figures showed 1,773,412 fixed penalty notices were given to drivers in 2006, up from 712,753 in 1997. Most speeding offences go unchallenged and motorists frequently accept speeding convictions without attending Court or seeing the evidence against them.

Do not assume that police evidence or photo evidence can never be challenged, they can.
Speed detection devices need to be properly placed, its users properly trained and proper procedures followed.

Mobile Phone

As from 1 December 2003 it has been a specific offence to use a hand held mobile phone or similar device when driving. Similar devices include any device that performs an interactive communication function by sending and receiving data. As such, navigation equipment, computer equipment and blackberry's may fall foul of this legislation.

There is a £60 fixed penalty with three penalty points for the offence rising to £1,000 on conviction in Court. This figure inflates to £2,500 for drivers of goods vehicles, buses or coaches. For the most serious cases, motorists who use mobile phones at the wheel could face a charge of dangerous driving and up to two years in jail. However, it still falls to the police and or the prosecution to prove the offence.

Motorists can use their mobile phones and similar devices whilst driving provided they use a hands free kit that enables them to be used without being held. Alternatively, motorists can use their mobile phone in their car provided they are safely parked up.
