Q) If a family member or friend is driving my car and they get caught speeding am I still liable?

A) Not necessarily, but you will be required to provide further information on who was driving the vehicle at the time in question.

 

Q) Do I need an operators licence?

A) A licence must be held by the operator of vehicles used to carry goods in connection with a trade or business on the public road if it exceeds in a gross plated weight of 3.5 tonnes or unladen weight exceeding 1525 kilograms.

 

Q) If I am caught driving under the influence of alcohol or drugs what could happen to me?

A) If convicted the disqualification ranges from the minimum 12 month disqualification to an unlimited period disqualification and a fine of up to £5,000. The Court also has the discretion to award a custodial sentence of six months.

 

Q) I have recently failed to stop and report an accident I caused, what are the consequences?

A) If you have been involved in an accident which caused damage or resulted in injury to either another vehicle, person or property then depending upon the circumstances you could be faced with the maximum penalty of up to 6 months imprisonment and/or a fine not exceeding £5000. You as the driver of the vehicle could also face disqualification from driving.

 

Q) What Penalities could a driver without a licence face?

A) The maximum penalty fine is £1000, however if they could obtain a relevant licence it could be subject to 3-6 penalty points and a period of disqualification subject to the discretion of the court.

 

Q) Can I argue exceptional hardship if I am faced with disqualification from driving?

A) Exceptional hardship could possibly be argued if disqualifying an individual from driving would harm or deprive another person such as a family member or the driver himself. It can also be argued on the basis of employment if the court thinks it would be unreasonable to disqualify an individual from driving if their employment relies heavily on just this.

 

Q) I was caught using my mobile phone whilst driving. Will I be fined?

A) Yes, you could receive a fine along with imposed penalty points. However, this is only if you were discovered using a hand held phone. If you use hand free equipment then you will not be subject to such Penalities.

 

Q) What is the maximum amount of points I am allowed on my licence before I am disqualified from driving?

A) The maximum amount of points allowed is 12. Then it will be for you to argue why you should not be disqualified from driving.
