Q) How is my claim started?
A) We send a letter of claim to the debtor requesting payment, if this is not achieved then we issue Court proceedings. A letter of claim is in effect a final warning.
Q) If I issue a statutory demand, how long has the debtor got to comply with it?
A) The debtor has 21 days or 28 days if they live abroad to satisfy the statutory demand. However, if they wish to set aside the demand then they have 18 days to do so, or 22 if they live abroad.
Q) If I am owed money by a Company instead of an individual are you still able to handle my claim?
A) Yes we will issue proceedings in exactly the same way as we do with individuals.
Q) How do solicitors differ from debt recovery agencies?
A) The most crucial difference between the two is the fact that solicitors are professionally qualified to assist you in any Court proceedings. Unless a debt recovery agency actually employs a group of solicitors to attend Court for them then they are not legally qualified to do so themselves. In this respect a law firm can assist you from beginning to end and you will be dealing with the same person who is handling your case throughout.
Q) What happens if the debtor does not pay even after judgment has been issued stating he must?
