Mortgages and Re-mortgages

If you are interested in mortgaging or re-mortgaging your home our specialist team can assist you and your lender with this, including redeeming any former mortgage/s and registering the new mortgage/s against the property at the Land Registry.

Transfer of Ownership

Our Team are able to assist with the transfer of your home to someone else. This may be where you wish to gift your property to a third party or where you transfer your property to someone else in return for some payment. Our Team can advise on all aspects of these types of transfer, whether at a value or as a gift.

Assents

Our Team are also able to assist with an assent of a home. This is where a property has been left to someone under the Will (or in the Administration of an Estate where there is no Will) of a person who has died and the property needs formally transferring into the relevant beneficiary’s name. Our Team are able to assist and advise on these matters to ensure that the property is properly transferred, in accordance with, either, the deceased’s wishes, or with who the law determines is to inherit.

Voluntary First Registrations

Many people may wish to deal with the first registration of their home voluntarily. If your property is unregistered and you are interested in having that registered with the Land Registry, then we can do that for you.

Some properties in England and Wales are still unregistered. This means that the property is not registered with the Land Registry and your proof of ownership will be contained within your Title Deeds. Although this is not a problem, some clients prefer the peace of mind that the property is registered.

Lettings

There are increasingly more and more homes that are available for letting, rather than for sale or purchase, because landlords see real property as a good investment.

Our Team can assist both landlords and tenants with the preparation and or consideration and approval of tenancy agreements, including how best to deal with the often called for tenant’s deposit.

 The above tables demonstrate our standard costs however these fees are subject to change to due several reasons such as the price of the property in question. Hodgkinsons Solicitors have the right to raise additional fees in addition to your fixed legal fees should one or more of these factors come to light. We have highlighted all the costs that are reasonably expected to be included in your quote, however there are several factors which may alter the quote during the course of a transaction such as the following

Leasehold Matter Disbursements

Disbursements on leasehold matters are potential additional prices which are not already accounted for. These prices are near impossible to estimate and would be between £100.00 to £500.00 but can be more or less.

 

Indemnity Policies

Indemnity Policies may be needed on matters to address enquiries, but the price varies as well but we advise the client as and when these are needed to take authority on the cost. Again, prices vary between £20.00 to £400.00.

 

What services are included in the displayed Conveyancing Fees and how long will it take?

For a purchase in this fee we are: -

  1. Obtaining contracts and details of the seller’s title to the Property;
  2. Conducting searches and raising enquiries;
  3. Perusing replies to enquiries and searches and reporting to you;
  4. Approving the contract;
  5. Obtaining details of your Mortgage and acting for your Lender;
  6. Checking financial arrangements;
  7. Exchanging contracts and arranging a completion date;
  8. Drafting the transfer deed and raising requisitions;
  9. Making pre-completion searches;
  10. Attending completion;
  11. Submitting SDLT Return to the Inland Revenue;
  12. Dealing with the registration at HM Land Registry.

For a sale in this fee we are: -

  1. Obtaining the title deeds and examining the same;
  2. Obtaining property Information and fixtures fittings and contents forms;
  3. Preparing the contracts and contract package for submission to the buyer’s Solicitors;
  4. Dealing with enquiries raised by the buyer’s Solicitors and replying to the same;
  5. Attending you with the contract for signature;
  6. Exchanging contracts and fixing a completion date;
  7. Obtaining redemption figures from the mortgage Lender;
  8. Approving the transfer and attending you with the engrossment for signature;
  9. Dealing with requisitions on title;
  10. Attending to the completion and accounting to you;
  11. Generally acting throughout on your behalf.

It is impossible to say how long a transaction will take and until Contracts have been exchanged, we cannot give a definite moving date.  However, most sale and purchase transactions take approximately 6 - 8 weeks to exchange of contracts with completion usually approximately 2 weeks thereafter.

On a purchase we then have to register the Property which can take any time depending on the Land Registry. This can take anywhere up to 6 months to 1 year however usually a registered freehold property will take around a month to register.

Our Team are always happy to give timescales on the anticipated completion of your matter but will do so on a bespoke basis as each transaction can be different and will potentially involve several parties and properties.
