Local Factory Worker Receives £5,500.00 for Industrial Illness Caused By Lack of Training

What Happened

Our Client was employed by a UK based Joinery Manufacturing Company for over 19 years. His job role consisted of working with machinery including CNC Routers, Spindle Moulding Machines and Thicknessers. These types of machines can create noise levels of up to 105dB.

The “Hear the World Foundation” state that it is impossible to understanding anything over a noise level of 105dB. A comparative example of this level of noise would be similar to being stood next to a motorcycle or tractor. This significant level of noise has the ability to cause serious damage in just 8 hours of exposure.

The Defendant Company acted upon their responsibility to provide our Client with sponge ear plugs as his protective equipment, however failed to provide training as to how to insert them correctly into the ears. As a consequence of this lack of training, the ear plugs would frequently fall out of our Client’s ears onto the floor where they would accumulate bacteria and dirt.

How Richard Helped

Richard Scott was able to successfully argue that as a result of the poorly administered earplug training, our Client suffered from Noise Induced Hearing Loss and Tinnitus. Our Client’s resulting hearing loss required hearing aids earlier than they would normally be expected. Had our Client’s employer provided the necessary training and checks, his Industrial Disease could have been prevented.

Richard Scott successfully secured our Client £5,500.00 in compensation for his pain, suffering and financial losses.
