Alcohol & Dangerous Driving
A conviction for drink driving can have disastrous results, leading to job loss, business failure, loss of home, marriage breakdown and other dire consequences.
Drink Driving
If convicted, disqualification ranges from the minimum 12 month disqualification to an unlimited period of disqualification and a fine of up to £5,000. The Court also has the discretion to award a custodial sentence of up to six months.
An allegation that you have committed an offence of drink driving does not necessarily have to lead to a conviction. It falls on the police and the prosecution to prove the offence.
The law governing drink driving offences is complex and by obtaining expert legal advice from our specialist team at an early stage, you may significantly increase the chances of the prosecution failing or achieving an acquittal.
Dangerous Driving
Dangerous driving is an extremely serious offence. If convicted of the offence you face a risk of imprisonment and an automatic disqualification of at least 12 months. You will also be required to sit an extended driving test before you are eligible to drive again.
Dangerous driving offences can include driving under the influence of alcohol or drugs, street racing, driving at excessively high speeds, undertaking, overtaking where it is illegal or simply driving dangerously, such as on a bend or a hill. Ignoring road signs or traffic markings while driving, use of a mobile phone , reading a map or driving a vehicle which is overloaded or not roadworthy are also offences.
Defending an allegation of dangerous driving requires specialist skills and expert cross examination as the case against you will largely be based on eye witness evidence and accounts from trained police officers. Early instruction of our specialist solicitors is crucial to ensure the best possible outcome for you.
