Penalty Points
More than a million motorists are now only one conviction away from losing their driving licence according to a survey carried out by a major insurance company.
Penalty points are imposed for a number of relatively minor driving offences for example speeding may carry as little as 3 penalty points. If a driver picks up a total of 12 penalty points within 3 years, a 6-month automatic disqualification will occur. This is known as 'totting up'.
New motorists will automatically have their licence revoked if they acquire 6 penalty points within 2 years of obtaining their licence and will be required to retake their driving test.
Not many people can contemplate the prospect of losing their licence for a few weeks, let alone 6 months. However, our specialist team may be able to persuade the Courts to make a finding of 'Exceptional Hardship' and allow you to continue to drive even with 12 points on your licence. For example, the loss of a job where it causes people such as partners, children or even an employer or employees hardship is generally viewed by the Court as beyond the intentions of the totting up provisions.
