Client Receives Five-Figure Settlement for Local Hospital’s Negligent Treatment

What Happened

Our Client visited her local A&E with complaints of abdominal pains, sickness and diarrhea. She was prescribed antibiotics through a grey cannula which was inserted into her right arm, having been admitted with Gastroenteritis.

Throughout her time in hospital our Client informed nurses on numerous occasions that the cannula was causing her pain and distress but this was unfortunately dismissed by hospital staff. The cannula was therefore left in situ throughout her stay in hospital, causing our Client pain and discomfort.

The cannula was eventually removed once our Client was discharged from Hospital but unfortunately the injury to her arm had already been caused by failing to remove the cannula in a timely manner. As a result, our Client developed Superficial Thrombophlebitis which is a painful inflammation condition of the skin.

In addition to developing Superficial Thrombophlebitis our Client was also incorrectly administered a penicillin-based medication despite medical staff being on alert that she was allergic to the same. As a result, she suffered an immediate allergic reaction. Fortunately, our Client’s injuries were not expected to last long term and she went on to make a full recovery.

How Chloe Helped

A Claim was brought on behalf of our Client for the negligent treatment she experienced whilst in hospital. Chloe Sullivan raised the issue that medical staff failed to remove the cannula in a timely manner despite our Client’s numerous requests. Had this been carried out, our Client’s injuries could have been prevented. Further allegations were successfully argued when Penicillin was administered despite the Hospital staff having clear knowledge of our Client’s allergy to the same.

The Result

It was accepted by the Defendant Hospital that steps should have been taken to remove the cannula upon our Client’s repeated requests but were unable to clarify why this occurred and why actions were not taken to correct her discomfort. It was also accepted that our Client was incorrectly administered a Penicillin based medication.

Chloe was able to successfully prove that our Client was owed a duty of care which was breached on several occasions. Upon the Defendant Trust admitting liability, Chloe entered into settlement negotiations and was able to secure an award of £12,000.00 for her Client’s pain, suffering and financial losses.
