TUPE Regulation stands for the Transfer of Undertakings (Protection of Employment) Regulations 2006. This piece of legislation aims to protect an employees’ conditions of employment and their legal rights in the instance that their employer’s business structure alters. There are many reasons why this may happen, such as:
- Your Company has been sold;
- Your Company is being transferred to a new owner;
- Your Company acquires the assets of another business;
- A service by your Company is being contracted out or outsourced;
- Your Company brings services in-house from a contractor.
TUPE Law ensures that employees retain their position under the same conditions of employment regardless of amendments to their Company. It also makes it a legal obligation for employers to ensure that employees have been made aware that the amendments will be taking place. One example of a case may be where a Company has been transferred to a new owner and an employee has experienced a change in pay, benefits or bonus.
How we can help
Restructuring a business can have many effects on employees, which is why it is vital that in such circumstances, employers seek legal advice regarding their legal obligations and the risks involved. To ensure that your business is compliant to TUPE Law, our Solicitors can help you to identify whether this piece of legislation applies in your circumstances. By addressing your obligations, we can help you to avoid future claims and employment tribunal hearings being bought against you.
It is important that employees understand their rights under the TUPE Law so that they can distinguish whether or not their rights have been infringed. At Hodgkinsons our Team of Solicitors can advise you on all aspects of TUPE Law. Our Employment Law Experts can also advise on TUPE Law matters which relate to unfair dismissal. If an employer chooses to dismiss an employee following a Company transfer or sale, and the reason for dismissal is in relation to this, the employee may have a claim for unfair dismissal. It may often be the case that an employer may ask an employee to dismiss their existing contract of employment and to accept a new one. If this happens, our TUPE Law Specialists recommend that you seek legal advice from one of our experts in this field before submitting your decision.
