Employment Tribunal Fees

This section gives you more of an understanding of the fees you may be required to pay should you choose to instruct Hodgkinsons Solicitors to assist with either defending or submitting an Employment Tribunal for unfair/wrongful dismissal.

We want to provide you with all the necessary information you need to be able to make an informed decision about who your legal representatives will be.

Our Dispute Resolution Department charge hourly rates for Employment Tribunal matters. Fees are dependent on the nature and complexity of the matter in question. Please see the table below which sets out our fees for the Employment Tribunal services we provide.

The fees described do not include the following disbursements. Disbursements are the fees that are paid to third parties such as Counsel, Court and other third parties.

Counsel's Fees In some cases, it may be necessary to instruct a Barrister to represent you at a tribunal hearing. The fee charged will be dependent on the Barrister instructed and VAT will be payable on this fee. The rate is charged on hourly rates; therefore, it will vary depending on the complexity of the matter, their instructions, the length of the hearing, and the number of papers involved. Whilst this differs for all cases, an example fee for a 2-hour conference may be £500.00 + VAT (£100.00); and an example fee for representation at a hearing may be £6,000.00 + VAT (£1,200.00).

Our Dispute Resolution Team can handle Employment Tribunal cases on a Conditional Fee/Contingency Fee Agreement (CFA). This is, however, determined on a case-by-case basis as is dependent upon the type, value, and complexity of the case. No awards of costs are usually made in Employment Tribunal cases; therefore, you will be required to make payment of our legal fees from any damages awarded which is usually 1/3 of the settlement fee. Where cases are not handled on a CFA basis, they will be handled on a private fee-paying basis, charged at the hourly rates explained above.

What services are included in the fees charged and how long will it take?

The process which your Solicitor will undertake when dealing with an Employment Tribunal claim are as follows:

  1. Initial discussion on the prospects of potential claims;
  2. Write to the employer (if appropriate);
  3. Submit your claim to the ACAS Early Conciliation Service;
  4. Issue Tribunal Proceedings;
  5. Represent at preliminary hearings;
  6. Enter into negotiation discussions;
  7. Enforcement of Court Proceedings if necessary.

Our Team are always happy to give timescales on the anticipated completion of your matter but will do so on a bespoke basis as each claim can be different due to the complexity of your case. The time taken to resolve an Employment Tribunal claim can vary, depending on whether it is straightforward or lengthy and whether there is scope for settlement. The timescale to complete the matter depends on the way in which the other party responds to the action taken. Completion may take between 2 – 18 months depending on whether Court Proceedings are required. This accounts for 3 months from instruction to issuing, however, once your claim is with the employment tribunal, this is when the time scales can vary. Settlement Agreement matters can be handled on a smaller timescale of a number of weeks, if necessary, which will include setting up a file, initial meetings, and discussion, execution, and distribution of the agreement.
