Tenancy deposit disputes
Here at Hodgkinsons Solicitors, Skegness, our Dispute Resolution Specialists can offer expert advice in the area of tenancy deposits. We can advise you on the steps to take to claim compensation if your Landlord has failed to protect your deposit in accordance with the Deposit Regulations.
Landlords usually request that new Tenants pay a deposit before they move in. However, there are specific procedures which a Landlord must follow when receiving a Tenant’s deposit. The law requires Landlords to place your tenancy deposits into a Tenancy Deposit Protection Scheme until it is returned to you when your tenancy terminates. Within 30 days of receiving your deposit, your Landlord should provide you with a copy of your ‘Deposit Protection Certificate’ and ‘Prescribed Information’ and if they fail to do so, you will be entitled to compensation.
Our Dispute Resolution Specialists are experts in Landlord and Tenant Law and can assist you with any of the following areas:
- If your deposit was not protected;
- If you did not receive your ‘Deposit Protection Certificate’ and/or ‘Prescribed Information’ within 30 days of paying your deposit;
- If you did not receive your deposit back when your tenancy terminated.
No matter how small or large the value of your deposit was, we can help you to reclaim what you are owed. As a Tenant you are legally entitled to receive between 1 and 3 times the value of your deposit in addition to the return of your agreed sum. Please remember that the limitation period for such claims is 6 years regardless of whether or not you are still living at the property in question.
